Data Protection Day 2023: All privacy laws and rights

The International Data Protection Day is celebrated today Saturday January 28, 2023. It is also known as ‘Data Privacy Day’ or the ‘European Data Protection Day’, since the celebration of this day is promoted by the European Commission, the Council of Europe and the Data Protection authorities of the member states of the European Union.

The objective of this day is to let citizens know what their rights and responsibilities around data protection. On the other hand, we also want to raise awareness and promote knowledge about the practices of privacy and data protection.

Laws and rights on data protection

In 2018 the General Data Protection Regulation (GDPR) in all EU countries. This regulation is characterized by the high fines that have been imposed for non-compliance.

This regulation includes the obligation with express written consent where the manifestation of free, specific, informed and unequivocal will to accept the processing of personal data is stated. As a novelty, a figure called “Data Protection Officer“to ensure compliance with said regulation.

In addition, there is also the right to be forgottenwhich was established by the Court of Justice of the EU in 2014. This means that there is a right to have a person’s private information removed from Internet searches.

The GDPR has a European character. But, on the other hand, there is also the Organic Law 3/2018 of Protection of Personal Data and Guarantee of Digital Rightswhich is national in scope, together with the Spanish Data Protection Agency (AEPD).

This day of data protection day 2023 is especially important in a context where new technological tools are emerging, some linked to Artificial Intelligence, which pay attention to the need to respect the privacy of citizens.
